1. Who these terms apply to

These Terms of Service (“Terms”) govern your use of the AWM Trading website (awm-trading.com) and any AWM Trading software, subscriptions, or support services (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service is — and is not

AWM provides automated futures trading software that runs on your own NinjaTrader 8 installation and trades through your own brokerage account. AWM is an independent software provider and is not a broker-dealer, registered investment adviser, commodity trading advisor, or commodity pool operator in any jurisdiction. Nothing on this site or in the Service constitutes personalized investment advice, a recommendation to buy or sell any security or derivative, or a solicitation for any investment product.

3. Risk disclosure

Trading futures involves substantial risk of loss and is not suitable for every investor. You may lose more than your initial investment. Past performance — whether hypothetical, back-tested, or live — is not indicative of future results. Automated systems can and do experience losing periods, drawdowns, and operational failures.

You are solely responsible for deciding whether futures trading and the Service are appropriate for your financial situation and risk tolerance. Use capital you can afford to lose. If you are uncertain, consult a licensed financial advisor before using the Service.

4. Your account and conduct

You agree to provide accurate information, to keep your credentials and broker account secure, and to use the Service only as authorized by these Terms and applicable law. You are responsible for every trade executed by the Service on your account, including while the software is enabled, disabled, or disconnected.

5. Trials, subscriptions, and payment

The 7-day trial runs on a demo (simulated) account and does not require payment. Paid subscriptions are billed in advance for the selected tier. You can cancel at any time; cancellation takes effect at the end of the current billing period and no refund is owed for the remaining portion of the period unless required by law. Setup fees, where applicable, are non-refundable once the onboarding work has begun.

6. License and intellectual property

AWM grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or single-entity trading during your active subscription. You may not redistribute, resell, reverse engineer, decompile, copy, or publicly disclose the Service or its components. All trademarks, logos, and proprietary technology remain the property of AWM Trading. Third-party marks referenced on the site (NinjaTrader, Rithmic, CME Group, Tradovate, AMP Futures) belong to their respective owners.

7. Third-party services

The Service relies on third-party infrastructure (including NinjaTrader 8 and your futures broker). AWM is not responsible for outages, errors, or losses caused by third-party providers. You maintain your broker relationship directly and are bound by that broker's own terms.

8. No warranty

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, profitability, uptime, or accuracy of any forecast, signal, or telemetry output.

9. Limitation of liability

To the maximum extent permitted by law, AWM and its principals will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any lost profits, lost trading opportunities, or account losses arising out of or relating to the Service. AWM's aggregate liability for any direct damages will not exceed the amount you paid AWM in the three months preceding the event giving rise to the claim.

10. Suspension and termination

We may suspend or terminate access to the Service for breach of these Terms, for non-payment, or to comply with legal obligations. You may terminate by cancelling your subscription and uninstalling the software.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates (Dubai) without regard to conflict-of-laws principles. Any dispute will be resolved in the competent courts of Dubai, unless mandatory law in your country of residence requires otherwise.

12. Changes

We may update these Terms as the Service evolves. The “Last updated” date above reflects the most recent material change. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
